Mid Ohio Honey Company General Business, Sales and Return Policies

It is our sincere intent to treat you as honestly and fairly as possible. With that in mind, we strive to maintain integrity, to provide you with the best service and the quality you've come to expect at Mid Ohio Honey. Our policies are strict guidelines which we adhere to for fairness in ALL business practices. We publish these guidelines to let you know upfront, exactly what our policies are.
If your purchases are via debit card or credit card your statement may reflect an outsource other than Mid Ohio. Your purchase from Mid Ohio, whether placed by phone, web site, letter, e-mail or any other means is interpreted as your willful and full adhereance to policies.

General Warranty -- Mid Ohio Honey Company warrants all defects in material and workmanship for 30 days from the time of shipment. We do not cover the damage resulting in abuse, alteration, misuse or use of a product other than it's intended purpose. The determination of abuse, alteration, misuse or use other than that of intended use will be determined by the Mid Ohio Honey Company. Please do not ask us for a cheaper price, that would mean decreasing our quality. Our Integrity just won't allow that, so please don't ask. Special pricing is available to clubs and organizations only.

Medications, Chemicals or Fumigants -- We do not provide any warranty or representation, express or implied for ANY medication or chemical treatment you purchase and apply to your bees. We can assume no responsibility for other application. We accept no responsibility for loss of bees, loss or damage to crops, loss or damage to property or personal illness, and or death due to your use or misuse of medications, chemicals or fumigants.

Purchase Policies:

ALL Bee Orders --
All Bees are inspected by the Department of Agriculture prior to shipping or pick up. Any disease, illness or parasite, mite, etc are not our responsiblity. Your claim (either by verbalization or writing) of acquiring disease or any harmful item from our bee source is considered slanderous and if determinded detrimental to our business will be handled legally. NO Bee orders will be filled if temperatures are below 50ºF or above 80°F, in the rain, or other inclimate weather.

The first day temperatures reach 50ºF packages will be filled in the order in which received. The estimated date of delivery is by no means an absolute or guaranteed date of availability. Only a guideline which we try to follow.

ALL replacement costs for losses are borne by the carrier and individuals making the purchase.

There is no guarantee of safe and/or live delivery of bees. Bees may be shipped from another contracted source for more rapid delivery or package size availability (i.e. 2# instead of 3#) at our/suppliers availability and/or discression. Bee prices are subject to change daily, up to the date of actual sale (i.e. charging of credit card, or receipt of payment), or date written on original invoice, regardless of any advertised prices. Mid Ohio Honey Company reserves the sole discresionary right to issue a "credit slip" for your purchase amount for bees IF we can not fill your order. This is NOT negotiable. Scheduled pick-up or delivery dates are flexible and weather dependant. However, if you fail to appear at the designated time for bee package pick-up, queen or Nuc pick-up, without prior arraingements you forfeit ALL of paid monies. We must do this to assure prompt pick up for the health of all bees. We do appreciate your understanding with this matter. Successful introduction is NOT guaranteed.

Package Bees and Queens (Picked up) -- Before you leave the premesis of the Mid Ohio Honey Company, you are responsible for inspection of bees, packaging, contents and you assume full responsibility of bees, the packaging container the bees come in or on and appropriate disposal of such container. Once you leave, you are fully responsible for any and all loss. We offer no guarantee--implied, oral or written for any bees. We must do this simply because we have no control of what you do with your bees after you leave the premesis, or your bees are placed in the delivery system. You may refuse to pick up your bees, then the order will be cancelled according to all applicable policies and you forfeit all paid monies. Scheduled pick-up dates are flexible and weather dependant. Mid Ohio Honey does not assume any responsibility for escape of said bees nor injury or accident resulting from such. We give no guarantee or assurance of laying ability of queens or success of package or introduction of packaged bees.

For Package Bees and Queens (Shipped) -- For All Bees shipped via USPS, UPS or common carrier No confirmation letter, call, email or notification will be sent. The cashing of your money order or check is your confirmation of order. If you experience any loss while in transit, you are responsible for initiating any repayment claim from carrier. We DO, provide MANDATORY insurance. Replacement costs including shipping or any additional fees are incurred by you and NO REPLACEMENT shipments will be shipped until we receive additional payment from you. Your replacement/new order will be shipped after all other scheduled shipments. Queen shipment losses are borne solely by the buyer -- Including queen losses in packages while in transit. We issue no assurance of laying ability of queens. Please keep in-mind we accept NO responsibility for ANY loss of bees. This is due again because we have no control of what happens to the bees after they leave our control.


Beekeeping Supplies
-- All non-bee shipments are shipped F.O.B. via common carrier, USPS, Fed-EX or UPS. Your freight carrier is entirely responsible for the complete and safe delivery of your merchandise. It is your responsibility to inspect your package when it is delivered. You may choose to file a claim for damage or loss with the carrier should a problem arise. Some shipments may actually cost more or less than calculated rate, and the additional shipping will be added to your invoice, credit card, debit card, etc... Any and all charges and overdraft charges to your account are entirely your responsibility and the Mid Ohio Honey Company assumes no liability for such instances. Any UNAUTHORIZED returns, cancelletions and misc transactions such as chargebacks for "non-receipt of merchandise" and credit card credits will be RECHARGED, if not in compliance with the return policies. Also, all applicable attorney, research, credit card usage fees, misc.fees, credit return fees and additional postage fees will also be charged to your credit card or placed on an immediately payable invoice, at our discression. If you choose to "stop payment" on a check, this will be considered as FRAUD and pursued as such. Your orders via any means of communication (telephone, mail order or email) gives specific permission to us to utilize your credit card, and may be charged (recharged) to a third party supplier or for additional shipments which may be drop-shipped from another supplier. It may take 4 (four) to 6 (six) weeks for delivery of merchandise--please allow this time, and plan accordingly. All prices are subject to change without previous notice. Any gift certificates are redeemable only for the item on the certificate and carries NO cash value. Any door prizes awared must be picked up at Mid Ohio or prior arraingements for any payment for shipping costs must be made. There is not free shipping on door prizes. Wax foundation will not be shipped if the temperature is below 60ºF. This is due to the wax being very fragile.

Deposit & Return Policies:

Deposits -- Deposits are required for special pricing bee packages, pollination services and special orders. Once receipts are received in our financial institution and cleared--your order will be processed. All deposits/payments for BEE PACKAGES, QUEENS or NUCS and SPECIAL ORDERS are NON-REFUNDABLE regardless of whether or not you pick up the merchandise at the arrainged time and place. Pollination Service deposits are refundable up to 50 %, IF cancelled in writing 30 days PRIOR to the scheduled setting date.

Returns & Credits, Cancellations and Disputes -- We accept most* returns, however they MUST meet the following requirements.
1.) Received at Mid Ohio within 30 days from the date the order was shipped from Mid Ohio.
2.) With an original receipt.
3.) In good, servicable and resellable condition without any alteration.
4.) A 20% restocking fee (for supplies) will be charged in all cases.
5.) If you decide to cancel your fully or partially paid bee order, shipped or partially shipped/filled, (packages, queens or NUCS) either picked up or shipped, all special pricing will be null and voided, a 100% cancellation fee will apply to balance of unshipped bees--NO REFUNDS on BEES. All processing fees will become the sole responsibility of the purchaser.
6.) If there are any descrepencies--you must notify us in writing within 30 days of purchase as to correct the situation as soon as possible--credits may take 30 business days, or up to two (2) full billing cycles on your credit card statement or credit issuance.
In addition, the full price of merchandise will be refunded, EXCLUDING shipping charges, restocking fees, cancellation fees, credit card processing fees, postage, and insurance and any other charge/expense that we incur. Your order (including bees) or return/cancellation of merchandise is your total and undeniable acceptance, adhearance and FULL agreement of these policies.
Deposits and payments paid via credit cards will be charged immediately after your order. Once receipts are received in our financial institution--your order will be processed. Any and all charges and overdraft charges to your account are entirely your responsibility and Mid Ohio assumes no liability for such instances.
In all business instances involving, but not limited to; bee purchases, pollination services, contractual engagements, rental, supplies, transportation and all other business transactions with Mid Ohio Honey, should any disagreement between the Mid Ohio Honey Company and any individual, group, entity or anyone, the other entity (personnally and professionally) fully agrees to arbitration and civil and/or criminal case management within the State of Ohio court system. The camplaintant shall also pay for ALL EXPENSES of the Mid Ohio Honey Company, agents, and witnesses. These include but not limited to; all associated legal (lawyer, research, postage, document fees, copy fees, telephone expenses, expert witness, witness fees and associated costs, ALL court costs, arbitration, etc...), transportation, housing, etc....
In addition any contracts or agreements either in writing or verbally with Mid Ohio Honey Company and any individual/entity that provide bees or supplies to Mid Ohio Honey are solely responsible for 100% of their own losses. We are not responsible for any loss whatsoever due do management, brokering, servicing, transporting, use, misuse, theft, misplacment, poisioning, destruction or and associated loss of leased, purchased, brokered, rented, loaned or otherwise used bees. Any substandard items (bees or supplies) supplied to Mid Ohio Honey Company shall be handled through arbitration according to policies. If suit/charges are initiated either civally and/or legally by claims made, then the claimant also agrees to pay for all expenses of the Mid Ohio Honey Company as noted in our policy statements. Any frivilous suit and or unfounded claim resulting in slanderous and or libelous, malicious claims and/or acts may also be pursued to the fullest extent of the law and a counter suit may be initiated and you agree to be responsible for ANY and ALL expenses. The policies will be in FULL EFFECT for any agreement either in writing or verbally. Your acceptance of provided bees (or acceptable substitution {brokering, different configuration and or amount, loaning, renting, etc...}) from MOHC or provision of bees to the MOHC in your full and clear understanding, and undeniable acceptance and enforcability of the terms of these policies. Engagement in any business with MOHC is again your full understanding and responsibility.

ATTENTION

All FULL payments for Bee Packages, Queens and NUC cancellations are NON REFUNDABLE and deposits (less that full payment) for Package Bees, Queens, NUCS and any SPECIAL ORDERS are NON-REFUNDABLE. All credits will be either "like-kind" or "credit slips" issued solely at our discression. Cash purchases will be processed as though purchased with a check and will be refunded as such according to policies. Credit card purchases May be credited with a "credit slip" for future purchases.

**We reserve the right to refuse sales to anyone and ammend policies without previous notice. There will be a retured check fee assessed to you if we receive a check returned for insufficient funds. If a "Stop Payment" on a check is made without previous arraingements for payment to be made, a flat fee of $100 will apply and will continue to be assessed at the rate of 25% of original purchase monthly. In addition all "stop payments" on checks will also be legally pursued as FRAUD**
